1. Who we are and what Ustazym is
Ustazym is an online platform for organising private lessons: scheduling, inviting students, reminders, keeping track of lessons and payments, and messaging between the tutor, the students and their parents.
The platform is provided by: ТОО «HighTengry», BIN 260840032425, Astana, Abubakir Tynybayev street 16, 6, e-mail hello@ustazym.kz (hereinafter "we", "the platform").
By using Ustazym you enter into an agreement with us on the terms of this offer. The platform is a tool for organising lessons: we are not a party to what the tutor and the student agree between themselves about the content, the quality and the price of lessons. Taking payments through the platform and acting as a tax agent become available as those functions are switched on; their terms are described on the pricing page (/pricing-terms) and in addenda to this offer.
2. Age and the consent of legal representatives
People aged 18 and over can register on the platform as a parent.
Tutoring services can be provided through the platform by people aged 18 and over, and also by people aged 16 and over if they are entitled to carry out such activity under the laws of the Republic of Kazakhstan (full legal capacity acquired before the age of 18, or the consent of legal representatives together with the appropriate tax status). The tutor is responsible for having that right; the platform may ask for confirmation.
Students aged 14 and over use the platform on their own: they keep their schedule, exchange messages and mark lessons as held. As the consent of a legal representative (a parent or a guardian) to this we treat an invitation sent to the student by a parent, or an invitation from a tutor acting with the knowledge of the parent, as well as a parent registering with a "parent and student" link.
As a rule the parent is the party to the financial arrangements: the parent sees the schedule and the payments of their child. A student aged 14 and over may pay for lessons themselves in the cases where the laws of the Republic of Kazakhstan allow such spending out of their own money (earnings, a scholarship), or where they have full legal capacity acquired before the age of 18. A link with a parent is not required in these cases, but it stays available: a parent can be connected to the student account at any time by invitation.
For students under 14 the account is managed by a parent.
The student account belongs to the student; a parent does not manage it directly but can contact us about matters concerning the account of their child (hello@ustazym.kz).
3. Your data and how long it is kept
We keep the data you have provided (name, phone number, e-mail, subjects and rates) and the data your work on the platform creates (lessons, payments, messages, notifications). The phone number serves as the identifier of the account: invitations find you by it.
Three periods apply when an account is deleted:
30 days: the period for changing your mind.
After a deletion request the account is kept in full. Any sign-in cancels the deletion. This is protection against an accidental or a hasty decision.
365 days: the window for coming back.
After 30 days we anonymise your personal data: the name, the phone number and the e-mail are removed from the profile, and the people you talked to see "Deleted user". But the sign-in methods are kept in a dormant state for another 11 months: sign in with any of them and you restore the account and the history of your lessons. You will need to enter your name and contacts again; the phone number may have been taken by someone else in the meantime, in which case you will need to confirm it again or give a different one.
5 years: the legal archive.
The link between the account and the person (full name, phone number, e-mail, the dates of the request and of the deletion) is kept in a closed archive that is not accessible through the platform. It exists for one thing: to answer official requests in the manner established by law, for example in a dispute or an incident, including ones involving minors. After 5 years the archive record is deleted for good.
The history of lessons and of correspondence is kept in anonymised form for the people you worked with: it belongs to them just as much as it belongs to you. Financial and tax records are kept for the periods established by law.

4. What you may and may not do
The platform is meant for organising real lessons. You may not: pretend to be another person; give a phone number that is not yours; use the platform for bulk mailings, for fraud or for any unlawful activity; try to get access to accounts that are not yours or interfere with the work of the platform.
We may suspend an account where there is reasonable suspicion of a violation, with notice and a chance to explain. Money and the history of lessons are not lost during a suspension.
You are responsible for the accuracy of the data you provide and for keeping access to your sign-in methods safe (Google, Telegram, phone, e-mail).
5. Changes to the terms, and how to reach us
We may change these terms, for example when new features appear (payments, tax agent). We will notify you on the platform of any material changes at least 7 days before they take effect; continuing to use the platform after that date means you accept the new version. The current version and the date it took effect are always published on this page. If you do not agree with the changes, you can delete your account before they take effect.
