Public offer

1. Definitions

Platform: the Ustazym service in the form of a website (ustazym.kz) and, as they are launched, mobile applications for iOS and Android. It is intended for organising the learning process between a tutor, a student and a parent: keeping a lesson schedule, tracking homework, generating reports, as well as other features available in the relevant version of the Platform.

User: an individual registered on the Platform.

Service: the provision to the User of access to the features of the Platform within the scope of the selected tariff plan.

This offer does not govern the payment for lessons between a parent (student) and a tutor: such settlements take place outside the Platform, and the Contractor is currently not a party to them.

2. Subject matter of the offer

The provisions of this section apply to Users who use the Platform as a tutor: only a tutor selects and pays for a tariff plan. Access for a parent and a student to their own accounts is provided free of charge and does not require a separate tariff plan.

2.1. The Contractor provides the User with access to the Platform within the scope of the selected tariff plan. The User unconditionally accepts the contents and terms of the selected tariff plan in accordance with clause 2.2 and, if the tariff plan is a paid one, undertakes to make payment on time in the manner set out in section 4.

2.2. The tariff plans and their contents are published in the relevant version of the Platform (the ustazym.kz website, as well as the mobile applications once they are launched) and may include: keeping a schedule and a list of students, tracking homework, reports for parents, export of data for tax reporting and other features as they become available.

3. Procedure for concluding the contract

3.1. The contract is deemed concluded from the moment the User registers on the Platform, regardless of the selected tariff plan.

3.2. To take out a paid tariff plan, the User goes through the payment page and confirms agreement with this offer.

4. Tariff plans and payment procedure

The provisions of this section apply to Users who use the Platform as a tutor.

4.1. Current tariff plans (in tenge, per calendar month): Basic: free of charge; Master: 5 000 ₸/month; Prime: 10 000 ₸/month. The current tariff plans and their contents are always set out on the /pricing-terms page. During the pilot period, paid tariff plans may be provided free of charge; this is stated separately on the tariff plans page.

4.2. The cost of the services is stated exclusive of VAT: the Contractor ("HighTengry" LLP) is not a VAT payer.

4.3. Payment is made by non-cash means: by bank card (Visa, Mastercard, UnionPay and other supported payment systems), via a QR code, as well as by other means that the Contractor may enable as the Platform develops, including electronic wallets and contactless payment services (for example, Apple Pay, Google Pay). The current list of available payment methods and of the banks or payment services that support them is displayed on the payment page at the time the payment is made. The User's bank card details and other payment credentials are neither transferred to nor stored by the Contractor: payment takes place on the secure page of the relevant bank or payment service.

4.4. The subscription is renewed automatically for the next period unless the User cancels it before the renewal date. Notice of an upcoming charge is sent in advance.

4.5. The date of payment is the date on which the funds are credited to the Contractor's account.

5. Procedure for cancelling services and refunding funds

The provisions of this section apply to Users who use the Platform as a tutor.

5.1. The User may cancel the subscription at any time in their personal account. Cancellation stops automatic renewal and means that the next charge is not made, provided that it is made at least 72 hours before the end of the current paid period. If cancellation is made later, the nearest charge may still be processed, and in that case cancellation stops renewal starting from the following period. In any event, access to the tariff plan already paid for is retained until the end of the corresponding period.

5.2. Funds for a paid period that has already begun are non-refundable, except in the cases provided for by the legislation of the Republic of Kazakhstan.

5.3. If a payment has been charged in error (a technical error, a duplicate payment), the User contacts hello@ustazym.kz. The refund is made within 10 business days after the error has been confirmed.

5.4. The refund is made by the same method as the payment was made.

6. Rights and obligations of the parties

6.1. The Contractor undertakes to keep the Platform operational, except during maintenance periods, of which the User is notified in advance where possible.

6.2. The User undertakes to provide accurate information upon registration and not to give third parties access to their account.

6.3. The Contractor may suspend the User's access in the event of a breach of the terms of this offer or of the Terms of Use (/terms).

7. Liability of the parties

7.1. The Contractor is not liable for the content of the learning process, the quality of the lessons or the settlements between the tutor, the student and the parent: the Platform is a record-keeping tool and not a party to the educational or payment relationships between them.

7.2. In all other respects, the liability of the parties is governed by the legislation of the Republic of Kazakhstan.

8. Personal data

8.1. The User's personal data is processed in accordance with the Privacy Policy (/privacy).

9. Term and amendment of the offer

9.1. The offer is in force from the moment it is published on the website until the Contractor terminates it.

9.2. The Contractor may amend the text of the offer at any time by publishing a new version on the same page.

9.3. A new version of the offer comes into force from the moment of its publication and applies to all Users, including those who registered or paid for a tariff plan before it was published. By continuing to use the Platform after a new version has been published, the User accepts its terms. If the User does not agree with the amendments, they may cancel the subscription in the manner provided for in section 5.
